Service Agreement - Terms & Conditions
Your use of CustomMadeSongs.com, including your payment, shall indicate a conclusive acceptance of this agreement.
CustomMadeSongs.com songwriters and producers have full creative freedom when writing and producing the song. We do not accept any requests for refunds due to dissatisfaction with the song. We can offer a refund if we don’t approve your request for a song or if we don’t deliver the song.
CustomMadeSongs.com reserves the right to deny any request for a song if we feel that it is not morally acceptable to write / produce a song for a specific theme, brand or individual.
CustomMadeSongs.com will try to use as much of your input as possible/workable. CustomMadeSongs.com cannot guarantee to use all of your input. CustomMadeSongs.com can only commit to using a combined total of up to 3 specific words, names or or short phrases. CustomMadeSongs.com can only commit to using a combined total of only one of these attributes specified by you, the client: theme, occasion, mood or setting. CustomMadeSongs.com reserves the right not to include defamatory or vile lyrics.
The amount and quality of production is limited by the low base price paid to CustomMadeSongs.com. CustomMadeSongs.com cannot guarantee commercial radio quality production.
In return for your payment to CustomMadeSongs.com, CustomMadeSongs.com will provide you with an audio file of a song CustomMadeSongs writes and records based on your input. Delivery of the file will be by attachment or link sent by email to the email address specified by you. The song will be considered delivered even if your email address is bouncing or not working correctly.
Ownership of compositions (melodies and lyrics) and recordings, including all copyrights, and rights to royalties will remain property of CustomMadeSongs.com. CustomMadeSongs.com retains the right to release or reproduce in any way or form the song based on your input. CustomMadeSongs.com also retains the right to license the song to any entity for any use.
CustomMadeSongs.com may distribute all recorded songs online as streamed audio / video and links through YouTube.com, Facebook.com, Twitter.com, Flickr.com and CustomMadeSongs.com. However, ordering a new song through CustomMadeSongs.com does not grant you any distribution or publishing rights in any other format or media, such as TV, radio or as mp3-files. CustomMadeSongs.com hold all legal rights for any distribution in other channels or formats, and thus, local laws for royalties and copyright will apply for such distribution. If you wish to use a song from CustomMadeSongs.com for promotional purposes please get in touch with us.
CustomMadeSongs.com' recordings and songs may not be used commercially, or in order to generate revenue, without first obtaining a license from CustomMadeSongs.com. Commercial uses which are available after obtaining the appropriate licenses include: use of CustomMadeSongs.com' recordings or songs in advertising; use as background music; use in film, tv, multimedia, web, etc; sheet music; sale or resale of songs or recordings; use in compilations, and other commercial uses. By placing your order, you authorize that you have full legal rights to use and publish any uploaded information or material (music composition/lyrics in all formats, audio files, video files, images, logotypes, fonts, trademarks etc.). When you submit content to CustomMadeSongs.com you simultaneously grant CustomMadeSongs.com an irrevocable, worldwide, royalty free license to record, publish, display, modify, distribute and syndicate your content worldwide.
